Online Gambling Laws

This prompted several House Representatives to introduce several bills aimed at softening the federal Internet gambling law.

One of the more contested areas of the law is the definition of illegal Internet gambling. According to the Department of Justice, all Internet gambling in the United States is illegal. It defines unlawful Internet gambling as “using the internet to place or receive a bet.” The same definition does not apply to financial transaction providers.

Whether the Department of Justice’s arguments are successful is dependent on a number of factors, including whether the Commerce Clause gives Congress the authority to regulate gambling. If so, Congress may have the power to control gambling activities on Native American territories. Other legal questions involve the Travel Act and the Wire Act.

Under the Travel Act, a player is guilty of an offense if he or she uses interstate facilities to engage in an unlawful activity. Similarly, the Wire Act applies to wagering businesses and can be punishable by fines and imprisonment. But there is an exception for acts that are legally permissible in both the source and destination locations.

Another law that has been questioned is Section 1956 of the federal tax code. While the act does not actually include online gambling, the statute creates several distinct crimes, such as laundering and concealing, which can be used to protect money or other property from tax authorities.

Another issue that has been raised is whether the law is applicable to remote gaming. Remote gaming refers to gaming activities that occur outside of a physical location, such as casinos, racetracks, and online sportsbooks. Several courts have held that the law does not apply, primarily because it does not cover the entire telecommunications infrastructure.

Nevertheless, there are still significant hurdles for the Justice Department in regulating Internet gambling. The Commerce Clause doctrine, which theorizes that federal power lies in the hands of the federal government, has been used to defend the unconstitutionality of state law that exceeds the boundaries of the states.
